These Terms of Service ("Terms") govern your use of the Sofia mobile application (the "App") and the services provided by Bliss Coach ("we," "us," or "our").

1. Agreement to Terms

By downloading, installing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.

2. Eligibility and User Account

• Minimum Age: You must be at least 13 years old to use the App, in compliance with international privacy laws.

• Account Creation: While account creation is optional (you can use the App anonymously), if you choose to create an account (via email/password, Apple Sign-In, or Google Sign-In), you are responsible for maintaining the confidentiality of your account credentials.

• Prohibited Actions: You must not create multiple accounts to circumvent limitations or share your account with others.

3. Acceptable Use

The App is provided for your personal, non-commercial, and educational use only. You agree not to:

• Use the App for any illegal, harassing, abusive, or harmful purpose.

• Attempt to gain unauthorized access to the App, its systems, or user data.

• Copy, modify, distribute, sell, or reverse-engineer any part of the App or its content.

• Use any automated system (bots, scripts, etc.) to access the App.

4. Intellectual Property Rights (IP)

• App Content: All content, design, code, lessons, structured data, and the AI character "Sofia" are the exclusive property of Bliss Coach or its licensors.

• User Content: You retain all ownership rights to the audio recordings and chat messages you provide. However, by providing this content, you grant Bliss Coach a worldwide, royalty-free, non-exclusive license to use, host, reproduce, and adapt your content solely for the purpose of operating, improving, and promoting the App (e.g., processing your voice for transcription, using chat history for context).

• No Commercial Use: You may not use any Bliss Coach trademarks (including "Sofia") without our prior written permission.

5. Purchases and Subscriptions (Not Applicable in this Version)

NOTE: This version of the App does not include In-App Purchases (IAPs).

• Future Provision: Should we introduce premium subscriptions or IAPs, they will be governed by these Terms and processed exclusively by the App Store (Apple) or Google Play (Google).

• Refunds: Any refunds will be subject to the respective policies of Apple or Google.

6. Limitation of Liability and Disclaimer

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Bliss Coach is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. In no event shall our total liability to you for all damages exceed the amount you have paid to us for using the App in the twelve (12) months preceding the claim, or one hundred Euros (€100) if you have not had any paid subscriptions.

7. Modification and Termination

• Modifications to the Service: We reserve the right to modify or discontinue the App (or any part thereof) with or without notice. We will notify users of any major changes that significantly impact the service.

• Termination by User: You may stop using the App and terminate your account at any time by deleting the App and using the "Delete My Account" feature in the App's settings.

• Termination by Bliss Coach: We may terminate or suspend your account access immediately, without prior notice or liability, if you breach these Terms.

8. Governing Law and Jurisdiction

These Terms shall be governed by the laws of France, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Paris, France to resolve any legal matter arising from these Terms.

9. General Provisions

• Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and Bliss Coach regarding the App.

• Severability: If any provision of these Terms is deemed invalid, the remaining provisions will remain in full force and effect.

• Changes to Terms: We may revise these Terms from time to time. If a revision is material, we will provide at least 30 days' notice before the new terms take effect. By continuing to access or use the App after those revisions become effective, you agree to be bound by the revised terms.
